Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Growth Labs client hub (the “Service”), provided by Growth Labs (“Growth Labs,” “we,” or “us”). By accessing the Service, you agree to these Terms.

1. The Service

The Service is a private portal that lets Growth Labs and its clients collaborate on onboarding, content review and approvals, reporting, requests, and file sharing. Access is provided to invited client users and authorised Growth Labs team members only.

2. Accounts and access

• You receive access by invitation. You are responsible for keeping your login credentials confidential and for all activity under your account.
• You must provide accurate information and notify us promptly of any unauthorised use of your account.
• You may only access the company portal you are authorised for, and you must not attempt to access another client’s data.

3. Acceptable use

You agree not to:

• Use the Service for any unlawful, harmful, or fraudulent purpose.
• Upload content that infringes intellectual property rights or that you do not have the right to share.
• Attempt to probe, scan, breach, or circumvent the security or access controls of the Service.
• Disrupt or interfere with the integrity or performance of the Service.

4. Your content

You retain ownership of the materials you upload or provide (“Your Content”). You grant us a limited licence to host, process, and display Your Content solely to provide the Service and the agency work you have engaged us for. You are responsible for ensuring you have the rights to share Your Content with us.

5. Our materials

The Service, including its software, design, and the Growth Labs brand, is owned by Growth Labs or its licensors and is protected by intellectual property laws. These Terms do not grant you any right to our trademarks or software except as needed to use the Service.

6. Service availability

We work to keep the Service available and reliable, but we provide it “as is” without warranties of uninterrupted or error-free operation. We may modify, suspend, or discontinue features from time to time.

7. Privacy

Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.

8. Payments, acceptable use, and disclaimers

If you purchase paid services, our Refund & Billing Policy applies. Your use of the Service is also governed by our Acceptable Use Policy, and marketing outcomes are subject to our Results Disclaimer. These documents form part of these Terms.

9. Electronic records and signatures

You agree that we may communicate with you electronically and that agreements, proposals, approvals, and consents completed through the Service (for example, accepting a proposal or approving content) may be signed or agreed electronically. Electronic records and signatures have the same legal effect as handwritten ones, to the fullest extent permitted by applicable law (including the U.S. E-SIGN Act).

10. Limitation of liability

To the maximum extent permitted by law, Growth Labs will not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill, arising from your use of the Service. Nothing in these Terms excludes liability that cannot be excluded by law.

11. Termination

We may suspend or terminate access if you breach these Terms or if your engagement with Growth Labs ends. You may stop using the Service at any time. On termination, the relevant sections of these Terms (including ownership, liability, and governing law) survive.

12. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. Disputes will be subject to the exclusive jurisdiction of the competent courts there, unless mandatory local law provides otherwise.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after a change means you accept the updated Terms.
